American-Standard warrants that its plumbing products shall be free from manufacturing defects for a period of one year after initial installation (unless otherwise specified in writing). If an inspection by an authorized American Standard representative within one year of initial installation discloses that any of its repair parts or other plumbing products are defective in materials or workmanship. American Standard will repair or, at its option, exchange the product for a similar model or product or make a refund for the product.

This warranty applies only to the original purchaser and installation of these products.

This warranty does not apply to local building code compliance. Since local code requirements vary greatly throughout the country, Distributors, Authorized Service Representative, Dealers, Installation Contractors and users of plumbing products should determine whether there are any code restrictions applicable in any way to the product to insure local code compliance before installation. American-Standard makes no representation or warranty regarding, and shall not be responsible for, any code compliance.

This warranty shall be void if the product has been moved from its initial place of installation; if it has been subjected to faulty maintenance, abuse, misuse, accident or other damages; if it was not installed in accordance with American-Standard’s instructions; or if it has been modified in a manner inconsistent with the product as shipped by American-Standard.

American-Standard’s option to repair, exchange or provide a refund for the product under this warranty does not cover any labor or other costs of removal or installation. American-Standard shall not be responsible for and disclaims any liability for such costs or for any other incidental or consequential damages attributable to a product defect or to the repair, exchange or refund of a defective product, all of which are expressly excluded from this warranty. Implied warranties, including that of merchantability or fitness for purpose intended are expressly limited to the duration of this warranty. (Some states or provinces do not allow the exclusion or limitation of implied warranties, so this exclusion or limitation may not apply.)

This warranty gives you specific legal rights. You may have other statutory rights that vary from state to state or from province to province, in which case this warranty does not affect such statutory rights.

Distributors hereby acknowledge and agree that the above is the exclusive warranty provided by American-Standard. Distributors hereby undertake and agree that they will indemnify American-Standard from all loss, cost, damage or expense (including reasonable attorneys’ fees) that American-Standard may incur if: (a) Distributors give any warranty to Distributors’ customers with terms differing from, or more extensive than, the above; or (b) Distributors fail to provide notice or cause notice to be given to any of Distributors’ customers of the terms of this limited warranty, including but not limited to, that American-Standard shall not be responsible for labor or other costs due to installation or removal or cost of repair by others, nor for direct, indirect, consequential or incidental damages.
